The following definitions shall apply to all capitalized uses of the terms defined, and to any other use where the definitions provided would reasonably apply.
Data: All information that a User submits to MyTyrn via the Website. This definition includes, where applicable, the definition of "Data" provided in any applicable Data Protection Law.
Cookies: Small data files placed on your computer or other device by the Website when you visit certain parts of the Website and/or when you use certain features of the Website. Details of the cookies used by this Website are set out in the section below labeled "Cookies."
User: Any person who accesses the Website, either on their own behalf or on behalf of another person or entity, and is not an agent or employee of MyTyrn.

"person" includes both natural persons and legal entities;
"including" means "including without limitation";
What Data MyTyrn Collects:
MyTyrn may collect the following Data, which may include personal Data, from Users and/or third parties:
the names of Users and their agents and employees;
contact Information such as email or physical addresses and telephone numbers;
such other relevant data as MyTyrn, at its sole discretion, believes relevant and/or useful in providing its goods and services to the marketplace.
How MyTyrn Collects Data:
MyTyrn may collect Data in the following ways:
Data may be given to MyTyrn by Users;
Data may be received from other sources including third parties and publicly available sources; and
Data may be collected automatically from Users of the Website during their use of the Website.
Data That Is Given to MyTyrn by Users
MyTyrn may collect User Data in a number of ways, for example:
when a User contacts MyTyrn through the Website, by telephone, physical mail, e-mail or through any other means;
when a User registers with MyTyrn, on the Website or otherwise, and sets up an account to allow that User to use MyTyrn's products and services;
when a User elects to receive marketing communications from MyTyrn;
when a User uses any other service provided by MyTyrn.
Data Received From Third Parties
MyTyrn may receive User Data from the following third parties:
Providers of services related to the services which MyTyrn coordinates through the Website;
Marketing information service providers.
Data Received From Publicly Available Sources
MyTyrn may receive User Data from the following publicly available sources:
Phone books and the electronic equivalents thereof;
Corporate, licensing and regulatory filings available for public view;
Websites, social media, and other publicly provided information made available by potential customers for MyTyrn's products and services.
Data Collected Automatically
To the extent that Users voluntarily access the Website, MyTyrn may collect User Data automatically. For example:
MyTyrn automatically collects some information about User visits to the Website. This information helps MyTyrn to make improvements to the Website, and may include IP addresses, the date, times and frequency
with which Users access the Website and the way Users use and interact with the Website's content.
MyTyrn may collect User Data automatically via cookies, in line with the cookie settings on the User's browser. For more information about cookies, and how MyTyrn uses them on the Website, see the section below, headed "Cookies".
MyTyrn's Use of Data
Any or all of the above Data may be required by MyTyrn from time to time in order to provide Users with the best possible service and experience when using the Website. Specifically, Data may be used by MyTyrn for the following reasons:
internal record keeping;
improvement of MyTyrn's products and services; and,
transmission by email or other means of marketing materials that may be of interest to Users.
MyTyrn may use User Data for the above reasons if MyTyrn deems it necessary to do so for any legitimate purpose. If a User is not satisfied with this, that User has the right to object in certain circumstances (see the section headed "User Rights" below).
For the delivery of direct marketing to Users via e-mail or other reasonable means, MyTyrn will obtain User consent, either via direct consent ("opt-in") or implied consent ("soft opt-in.") A soft opt-in is a specific type of consent which applies when Users have previously interacted with MyTyrn (for example, if a User contacts MyTyrn to ask for details about a particular product or service, and MyTyrn is marketing similar products/services). Under "soft opt-in" consent, MyTyrn will take User consent as given unless specifically refused or withdrawn.
For other types of marketing, MyTyrn will obtain explicit consent by, for example, providing a check box which signifies that the User has consent to marketing contact. Users have the right to withdraw consent for marketing contacts at any time. To find out how to withdraw consent, see the section headed "User Rights" below.
When Users register with MyTyrn and set up an account to receive MyTyrn's services and/or use the Website, the legal basis for using, retaining, and processing User Data is the performance of a contract between Users and MyTyrn and/or preparing to enter into such a contract at the request of a User.
Who MyTyrn Shares Data With
MyTyrn may share User Data with the following persons for the following reasons:
Any affiliated company - to provide maximum benefit from MyTyrn's services to Users at minimum cost;
MyTyrn's employees, agents and/or professional advisors - to provide maximum benefit from MyTyrn's services to Users at minimum cost;
Regulatory and Law Enforcement Authorities - to facilitate the detection of unlawful activity or regulatory non-compliance; and,
Such other persons or entities as are necessary, in the reasonable judgment of MyTyrn, to provide the maximum benefit of MyTyrn's services to any given User for the minimum cost, upon reasonable notice to such Users.
MyTyrn uses both technical and procedural methods to protect User Data, for example controlling access to User accounts with unique passwords and user names, and storing User Data on secure servers. Technical and procedural methods include measures to deal with any suspected data breach. If a User suspects any misuse or loss or unauthorized access to User Data, they should immediately contact MyTyrn at email@example.com
Users have the following rights in relation to User Data:
Right to Access - The right to request (i) copies of the information MyTyrn holds about that User at any time, or (ii) to request that MyTyrn modify, update or delete such information. MyTyrn will not charge a User for access to the data MyTyrn has about that User, unless the request is unreasonable or duplicative. Where MyTyrn is legally permitted to do so, MyTyrn may refuse such a request. If MyTyrn refuses such a request, Users may further request an explanation for the refusal.
Right to Correct - the right to have a User's Data corrected if it is inaccurate or incomplete.
Right to Erase - the right to request that MyTyrn delete or remove that User's Data from MyTyrn's systems.
Right to Restrict Use of User Data - the right to "block" MyTyrn from using a User's Data or limit the ways in which MyTyrn can use it.
Right to Data Portability - the right to request that MyTyrn move, copy or transfer a User's Data.
Right to Object - the right to object to MyTyrn's use of a User's Data including where MyTyrn uses it for otherwise legitimate reasons.
To ask questions regarding a User's Data, exercise any of the User Rights set out above, or withdraw a User's consent to the processing of that User's Data (where consent is MyTyrn's legal basis for processing that User's Data), that User should contact MyTyrn at privacy@MyTyrn.com.
It is important that the Data MyTyrn holds about Users is accurate and current. MyTyrn requests that Users inform MyTyrn if that Data changes while it is being stored by MyTyrn.
Transfers Outside the European Economic Area
Users located in or subject to the jurisdiction of the European Economic Area (EEA) are advised that Data which MyTyrn collects may be stored and processed in and transferred to countries outside of the EEA. For example, this could occur if MyTyrn's servers are located in a country outside the EEA or one of MyTyrn's service providers have operations in a country outside the EEA.
For the avoidance of doubt, Users should assume that User Data is and will be stored, processed in, and transferred to countries outside of the EEA. Users who do not or can not accept this should not use the Website.
MyTyrn will only transfer Data collected in the EEA outside the EEA where it is compliant with data protection legislation and the means of transfer provides reasonable safeguards in relation to User Data. To ensure that User Data receives an adequate level of protection, MyTyrn will put in place appropriate safeguards and procedures with the third parties with which MyTyrn may share User Data. MyTyrn will use all reasonable efforts to ensure that User Data is treated by such third parties in a way that is consistent with Data Protection Laws.
Changes of Ownership and Control
MyTyrn may expand or reduce its business and this may involve the sale and/or the transfer of control of all or part of MyTyrn. Data provided by Users will, where it is relevant to part of MyTyrn's business being transferred, be transferred along with that part and the recipient shall be permitted to use the Data for the purposes for which it was originally supplied to MyTyrn.
MyTyrn may also disclose User Data to a prospective purchaser of its business or any part of it, so long as it uses reasonable diligence regarding such purchasers and provides reasonable safeguards for the protection of such Data.
The Website may place the following types of Cookies:
Required: Cookies required for the operation of the Website.
Performance Tracking: Cookies which allow the Website to recognize and count the number of visitors and to see how visitors move around the Website when they are using it.
User Functionality: Cookies used to identify and track the preferences of specific Users upon return visits to the Website.

This Agreement will be governed by and interpreted according to the law of the United States of America and, where not conflicting with Federal law, the law of the State of Illinois. All disputes arising under the Agreement will be subject to the exclusive jurisdiction of the state and Federal courts having jurisdiction over Cook County, Illinois.
